Legal Information and Personal Data Processing Policy

Birding Medellín Tours, a brand operated by Sebastián Palacio García, a natural person identified with Colombian Tax Identification Number (NIT) 1017242646-9, (hereinafter, the “Company”), in compliance with Colombian Law 1581 of 2012, Decree 1377 of 2013, and related regulations on personal data protection, hereby informs clients and users of this Personal Data Processing Policy, which governs the collection, use, storage, and protection of the information provided through our website and associated platforms.

The Company only collects the following personal data through Shopify and PayPal:

  • Name

  • Email address

  • Mobile phone number

  • Physical address (including city and country)

The Company does not collect financial data or sensitive personal data. Payment information is managed directly by PayPal, under its own international security standards.

3. Purpose of Processing

The personal data collected will only be used for the following purposes:

  1. To contact the client regarding purchased services (booking confirmation, tour coordination, logistics information).

  2. Administrative management of bookings and related services.

  3. Marketing and promotional activities (such as email marketing campaigns), provided that the data subject has not objected to receiving such information.

  4. Compliance with legal obligations when required by competent Colombian authorities.

4. Data Storage

The personal data collected will be stored on Shopify’s servers and will remain there as long as the platform retains the information. The Company will not make additional local copies unless required for the purposes described above.

5. Rights of Data Subjects

In accordance with Colombian law, data subjects are entitled to the following rights:

  • To know, update, and rectify their personal data.

  • To request the deletion of their personal data when they consider that it is not being processed in accordance with legal and constitutional principles, rights, and guarantees.

  • To revoke the authorization granted for data processing.

  • To file complaints with the Superintendence of Industry and Commerce of Colombia (SIC) for violations of data protection regulations.

6. Procedure to Exercise Rights

Data subjects may exercise their rights by submitting a request via email to: sebastian.palacio.10a@gmail.com. The Company will respond within the timeframes established by Colombian law.

7. Term of Validity

This policy is effective as of its publication date and shall remain in force while the Company continues to process personal data.
