Refund and Cancellation Pollicy
Refund Policy
Birding Medellín Tours, operated by Sebastián Palacio García (NIT 1017242646-9), informs its clients of the following Refund Policy, established in compliance with the Colombian Consumer Statute (Law 1480 of 2011) and other applicable regulations.
1. Free Cancellation Period
Clients may cancel their booking free of charge up to 24 hours prior to the scheduled start time of the tour. Any cancellation made after this period will not be eligible for a refund.
2. Refundable Amount
In the event of a timely cancellation, the Company will refund the net amount actually received, after deductions for commissions charged by PayPal or Bold (our payment processors for online/card transactions). Considering fixed fees and possible currency conversion, these commissions are typically around 5.5% to 7% of the amount paid, and are withheld before funds are credited to the Company.
3. Method of Refund
Refunds will be issued as follows, based on the original method of payment:
a) Payments made via PayPal:

Refunds will be processed exclusively through PayPal, to the same PayPal account or a PayPal account designated by the client.

The refund will be made in USD and will correspond to the net amount actually received in USD by the Company (i.e., after PayPal fees and any currency conversion charges applied by PayPal).
b) Payments made via the provided payment link or QR code for credit card payments (BOLD S.A. BANK):

Refunds will be made only to a PayPal account provided by the client, as the Company cannot transfer funds internationally from the BOLD bank.

The refunded amount will correspond to the net amount actually received by the Company, subject to any fees charged by third parties at the time of refund.
c) Cash payments:

Refunds can be issued in cash in Medellín, Colombia.

If a cash refund in Medellín is not feasible, the Company will refund in USD as follows:

If the original cash payment was in USD, the refund will equal the USD amount received.

If the original cash payment was in COP, the refund will equal the USD equivalent of the COP amount received, calculated using the USD exchange rate applicable on the date the cash was received.

4. Commissions and Third-Party Charges
The Company will only refund the net amount effectively credited. Commissions charged by PayPal or Bold (which typically total around 5.5% to 7% of the amount paid, depending on currency, card origin, and network fees), as well as charges by intermediary/acquiring/issuing banks or the client’s receiving bank, are not refundable and remain the responsibility of the client. Consequently, the final amount received by the client may be lower than the original payment.
5. Non-Refundable Cases

Cancellations requested less than 24 hours prior to the start of the tour are strictly non-refundable.

Clients who fail to appear at the scheduled meeting point (“no-show”) are not entitled to any refund.
6. Force Majeure
In cases of force majeure or events beyond the Company’s control (e.g., natural disasters, road closures, strikes, or public order issues), the Company reserves the right to reschedule the tour or, alternatively, issue a refund of the net amount received, applying the same conditions as above.
7. Applicable Law and Interpretation
This Refund Policy is governed by Colombian law, particularly the Consumer Statute (Law 1480 of 2011). In case of conflict between this policy and any mandatory consumer rights, the latter shall prevail. Any dispute arising from the interpretation or enforcement of this policy shall be subject to Colombian jurisdiction.
